1. General Registration
    1. First and last name, company, and title of all registered individuals may be shared by TFI.
    2. Registrants give permission for the Hotel to provide TFI with information about their stay at the hotel, including their name. Registrants agree to defend and indemnify TFI and Hotel and their affiliates from and against any and all claims arising out of Hotel providing TFI the information.
  2. Event Program and Presentations
    1. The Fertilizer Institute (TFI) reserves the right to make any changes to the program in its sole discretion. Every effort will be made to keep presentations (if applicable), speakers (if applicable), times, and locations as represented. However, unforeseen circumstances may result in the substitution of one or more presentation topic(s) or speaker(s) or time(s) or location(s).
    2. TFI makes no endorsements of any presentation or product. The views, opinions, displays and presentations by speakers, exhibitors and sponsors at the event do not necessarily reflect those of TFI.
    3. Due to limitations imposed especially by certain plenary speakers, Registrants are to refrain from the audio- or videotaping of any presenters or speakers for any reason or purpose.
    4. In the event that the Event has to be cancelled, delayed, interrupted or the schedule altered due to events beyond the reasonable control of TFI or the event organizers, TFI will not be held liable to Registrants for any damages, losses or costs incurred, including but not limited to transportation and accommodation costs. TFI is not liable for changes in program date, content, speakers or venue.
  3. Professional Decorum
    1. Registrants are expected to behave in a professional manner. Obscene, unseemly, offensive, inappropriate, abusive, or threatening behavior directed to any other person is not conducive to a collegial learning nor business environment. TFI reserves the right at its sole discretion to prohibit entry to any person to the Event, or eject any person based on conduct or behavior deemed inappropriate by TFI staff, its agents and others working under its authority, without warning or refund.
  4. Personal Liability & Waiver
    1. Registrants voluntarily assume all risk to health and safety relating to the Event, whether occurring prior to, during or after the event. TFI accepts no responsibility for injury, illness, loss or damage of any kind to person or property. By submitting your registration, you are acknowledging that an inherent risk of exposure to COVID-19 and any other communicable diseases exists in any public place where people are present. By attending the TFI Event, you and any guests voluntarily assume all risks related to exposure to COVID-19 and any other communicable diseases and agree not to hold TFI; or any of its affiliates, directors, officers, employees, agents, contractors, or volunteers liable for any illness or injury.
    2. Registrants agree to waive, release and hold harmless TFI, its officers, directors, employees and agents, against any and all claims arising out of or in connection with the Event, except for TFI’s own gross negligence or willful misconduct.
  5. Media Release
    1. TFI may film, photograph, audio record or report in print on portions of the Event, including lectures and interactions in common areas. These recordings may be archived and used for educational and commercial purposes. By attending, Registrant consents to TFI’s global and perpetual use of his or her name, photograph, recorded voice and statements (“Information”) in whole or in part, in all media and/or distribution formats, now known and hereafter developed for any lawful purpose, including but not limited to marketing, advertising, publicity, educational, sales, trade, and promotional purposes, with no right of approval and no right to compensation. Registrant releases and discharges TFI from and against any and all claims, damages, costs and/or other liability arising from or relating to use of the Information. TFI shall be the exclusive owner of any and all rights, title and interest, including, without limitation, copyright, electronic and distribution rights, in and to any materials containing the Information created by or on behalf of TFI, in any form.
  6. Substitution and Badge Policy
    1. Substitution of registrations may be made at any time up to the Event start date with approval by TFI. Sharing of attendee badges/credentials is not permitted at any time. Badges/credentials are issued to, can be picked up by, and used by only the attendee named in the registration. Photo ID will be required for each attendee when collecting a badge onsite. Badges must be worn at all times during the Event. A TFI Event badge allows an attendee entry to the overall Event, but cannot guarantee admission to every session, lounge, or meeting area. Admission is subject to venue capacity and other requirements

 

TFI Virtual Programs Code of Conduct

TFI is committed to providing a safe, productive, and welcoming environment for all meeting participants and TFI staff. All participants, including, but not limited to, attendees, speakers, volunteers, exhibitors, TFI staff members, service providers, and all others are expected to abide by this Virtual Programs Code of Conduct. This Policy applies to all TFI meeting-related events, including those sponsored by organizations other than TFI but held in conjunction with TFI events, on public or private platforms.

By participating in the Virtual Program, you grant TFI the right at the Virtual Program to record, film, live stream, photograph, or capture your likeness in any media now available or hereafter developed and to distribute, broadcast, use, or otherwise globally to disseminate, in perpetuity, such media without any further approval from you or any payment to you. This grant to TFI includes, but is not limited to, the right to edit such media, the right to use the media alone or together with other information, and the right to allow others to use or disseminate the media.

TFI, in its sole discretion, reserves the right to change any and all aspects of the Virtual Program, including but not limited to, the Virtual Program name, themes, content, program, speakers, performers, hosts, moderators, venue, and time.

TFI has zero-tolerance for any form of discrimination or harassment, including but not limited to sexual harassment by participants or our staff at our meetings. If you experience harassment or hear of any incidents of unacceptable behavior, TFI asks that you inform Alice McKinnon or Valerie Sutton or call TFI at (202) 962-0490 so that we can take the appropriate action.

Unacceptable Behavior is defined as:

  • Harassment, intimidation, or discrimination in any form.
  • Verbal abuse of any attendee, speaker, volunteer, exhibitor, TFI staff member, service provider, or other meeting guest.
    • Examples of verbal abuse include, but are not limited to, verbal comments related to gender, sexual orientation, disability, physical appearance, body size, race, religion, national origin, inappropriate use of nudity and/or sexual images in public spaces or in presentations, or threatening or stalking any attendee, speaker, volunteer, exhibitor, TFI staff member, service provider, or other meeting guest.
  • Disruption of presentations during sessions or at other events organized by TFI throughout the virtual meeting. All participants must comply with the instructions of the moderator and any TFI virtual event staff.
    • Presentations, postings, and messages should not contain promotional materials, special offers, job offers, product announcements, or solicitation for services. TFI reserves the right to remove such messages and potentially ban sources of those solicitations.
  • Participants should not sell, trade, transfer, or share their access link and/or code, unless such transfer is granted by the Organizer.
  • Participants should not copy or take screen shots of Q&A or any chat room activity that takes place in the virtual space nor shall participants record or broadcast audio or video of sessions of the Virtual Program.

TFI reserves the right to take any action deemed necessary and appropriate, including immediate removal from the meeting without warning or refund, in response to any incident of unacceptable behavior, and TFI reserves the right to prohibit attendance at any future meeting, virtually or in person.

 

Guide to Antitrust Compliance

Trade association meetings provide a lawful and important opportunity for competitors to meet and to discuss items of a legitimate concern to the industry. At the same time, trade association meetings can provide a breeding ground for formal or informal discussions that could lead to conduct or agreements that violate the antitrust laws. Such discussions have ramifications for TFI and its individual members. TFI members should adhere to the following general guidelines when participating in TFI activities:

  • Do not discuss current or future prices or costs. 
  • Do not discuss what is a fair profit level. 
  • Do not discuss an increase or a decrease in price. 
  • Do not discuss standardizing or stabilizing prices. 
  • Do not discuss pricing procedures. 
  • Do not discuss cash discounts. 
  • Do not discuss credit terms. 
  • Do not discuss controlling sales. 
  • Do not ban or otherwise restrict legitimate advertising by competitors. 
  • Do not discuss allocating customers or markets to or among competitors. 
  • Do not complain to a competitor that its prices constitute unfair trade practices. 
  • Do not ask competitors why a past bid was so low, or to describe the basis for a past bid. 
  • Do not discuss refusing to deal with a company because of its pricing or distribution practices. 
  • Do not attend informal sessions in which industry problems or issues are discussed. 
  • Do not vote or act in your capacity as a TFI member with the intention to harm a competitor.

TFI’s Privacy Policy

The Fertilizer Institute (“TFI” “we” or “us”) cares about your privacy and the security of your information. This Privacy Statement describes how we collect and otherwise process your Personal Data (as defined below) in connection with:

  • Your use of and contact through the TFI website (the “Site”);
  • Your company’s membership in TFI;
  • Your attendance at TFI events, seminars, and other meetings; and
  • Other scenarios where we present or link to this Privacy Statement.

The Fertilizer Institute is the data controller of the Personal Data we collect under this Privacy Statement.

Personal Data We Process
Personal Data” refers to any information that relates to you directly or indirectly. We process the following categories of Personal Data:

  • Contact information, such as your name, address, email address, phone number, and business contact information; 
  • Technical information, such as data collected about your interaction with our websites;
  • Financial information, such as payment card and related information (sometimes through third parties who collect and process your financial information on our behalf);
  • Identification or background information, provided by you or collected by third parties as part of our assessment of your membership applications, research, and other engagements
  • Pictures; and
  • Any other information that you provide that can be used to identify you.

We collect your Personal Data from:

  • Direct interactions, such as when you become a member, sign up for a newsletter, register for an event, participate in surveys or questionnaires, or in any way engage with our personnel;
  • Cookies and automated technologies, such as when you interact with our website or click on links on our emails;
  • Third parties, when the circumstances arise, such as when we sponsor a conference and receive the conference attendee list from the conference organizer; and
  • Through social media, such as if you link to social media platforms or use social media plug-ins, we may (depending on your user privacy settings on that social media platform) automatically receive information about you from that social media platform.

In addition to Personal Data, we may collect information that does not relate to an identified or identifiable person. For example, we may collect the browser types, device types, and operating system information of our users. If any of this information can be used to identify you because, for example, we link it to your Personal Data, we will treat such information as Personal Data.

How We Use Your Personal Data
We, or our service providers, use your Personal Data for various purposes depending on the types of information we have collected from and about you, in order to:

  • Register you for and provide you access to your online account;
  • Obtain your subscription preferences and send eNewsletters and similar marketing communications;
  • Respond to inquiries, fulfill requests, and otherwise deliver customer service;
  • Conduct surveys and questionnaires;
  • Register you for events and deliver event-related materials;
  • Perform website analytics;
  • Obtain current contact information and update contact records in our CRM;
  • To comply with our legal obligations; or
  • For other purposes as disclosed at the time of collection.

We reserve the right to use information that is not Personal Data (such as anonymous information) for any legal purpose.

How We Share Your Personal Data
We will share your Personal Data within TFI, at your direction, as disclosed to you at the time of collection, or in the following circumstances:

  • Service Providers: We may provide your Personal Data to our service providers that help us run and manage our organization and process Personal Data solely on our behalf. The categories of service providers include: technology service providers, analytics service providers and marketing service providers.
  • Corporate Transaction: In the event TFI is involved in a merger, reorganization, acquisition or sale of all or a portion of its assets, or other corporate transaction, we may disclose your Personal Data as part of that transaction.
  • As Required By Law: We may disclose your Personal Data if we determine that the disclosure is necessary: (i) to comply with any law applicable to us, a request from law enforcement, a regulatory agency, or other legal process; (ii) to protect the legitimate rights, privacy, property, interests or safety of TFI, our business partners, personnel, or the general public; (iv) to pursue available remedies or limit damages; (v) to enforce our policies and procedures; or (vi) to respond to an emergency.

TFI is committed to complying with this Privacy Statement and the data protection laws, including those outside of the United States, that apply to our collection and use of your Personal Data. TFI is located in the United States, and we recognize that the laws in the United States may be different and, in some cases, less protective as the laws other countries, including the European Economic Area (“EEA”). By providing us with your Personal Data and using our Site, you acknowledge that your Personal Data will be transferred to and processed in the United States.

Cookies and Other Data Collection Technology: We use Cookies, Web Beacons (also known as pixel tags and clear GIFs) and other similar technology (together, “Data Collection Technology” on our Site. Data Collection Technology helps us improve your experience on our online services. For example, we use Google Analytics, a web-based analytics tool that tracks and reports on the manner in which the website is used to help us to improve it. Our services are not directed to or intended for use by minors. Subsequently, we will delete such Personal Data.

Marketing
If you do not wish to receive marketing-related emails from us, please click the unsubscribe link at the bottom of any marketing email, or email us using the information in the section “Contact Us.” Please note that even if we stop all marketing communications, you may still receive administrative, legal, and other important communications from us.

Your Rights
You may request to access or correct the Personal Data we maintain about you, and we will respond to your inquiry within a reasonable timeframe.   • Right to complain: You have the right to lodge a complaint with your Supervisory Authority if you are unhappy with how we process your Personal Data. COVID-19 Waiver

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is reported to be extremely contagious. The state of medical knowledge is evolving, but the virus is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and even possibly in the air. People reportedly can be infected and show no symptoms and therefore spread the disease. The exact methods of spread and contraction are unknown, and there is no known cure or vaccine for COVID-19. Evidence has shown that COVID-19 can cause serious and potentially life threatening illness and even death.

The Fertilizer Institute (and their affiliated entities) cannot prevent you from becoming exposed to, contracting, or spreading COVID-19 while attending its conferences and/or entering onto premises where The Fertilizer Institute events are held. It is not possible to prevent against the presence of the disease. Therefore, if you choose to attend a conference organized by The Fertilizer Institute and enter onto premises where its conferences are held, you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19.

ASSUMPTION OF RISK: I have read and understood the above warning concerning COVID-19. I hereby choose to accept the risk of contracting COVID-19 for myself in order to attend a The Fertilizer Institute conference and enter the conference premises. The conference is of such value to me that I accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order to attend in person.

WAIVER OF LAWSUIT/LIABILITY: I hereby forever release and waive my right to bring suit against The Fertilizer Institute and its owners, officers, directors, managers, officials, trustees, agents, employees, or other representatives for fault in connection with exposure, infection, and/or spread of COVID-19 related to attending its event. I understand that this waiver means I give up my right to bring any claim based in negligence, including for personal injuries, death, disease or property losses, or any other loss, whether known or unknown, foreseen or unforeseen.
